Really messed up....need advice asap

OK sweetie remember me used to be Simeybear? I got a DUI 8/7/2008. I swerved to miss hitting a deer hit a bridge instead the police came I failed the field test ( I had broken my foot) They took me to jail didn't have a cot they a threw a rubber mattress on the floor and I was treated so badly. Couldn't get medical attention for my foot. Not to mention they made me remove all my clothing and put on their orange jumpsuit. I say get an attorney in both states let them go over everything together and come up with a game plan. States share info and I would hate for you to be punished in both.
I had 2 one good ol boy who the judges knew then one very smart tactical one. I went to court one year later due to contiunace and evidence requests. I was scared to death. Bottom line I got house arrest for 7 days minimum fine and had to have interlock on my car for 6 months
Just breathe I know your scared I was too I cried for days. Get yourself into an alcohol awarness program in what ever state you decide to claim as home. here in VA it's called ASAP. Get that over with you will be ordered to take one anyway and it shows that you are contrite and it looks good for you going into court.

Hi Tough, I hope everything turns out OK for you. I've never had a DUI before but I can imagine the fear and dread you're feeling right now. Simey has such great advice and she's a really great friend, she'll be able to help you out more as I'm sure everyone else will here as well, but I'm here for a helping hand and whatever support I can give you...even just a phone call to make you laugh and smile. My heart goes out to you honey, you'll get through this and you have lots of support.

I believe you will be put on antabuse and still be able to drive for work.
The antabuse will make you sick if you drink while on it, it's not like the mod pills members on here take.

I find it odd that they can force you to take a drug IE Antabuse. What if you were to have an allergic reaction,Then what? As I recall you have medical issues that might not work with that drug. A interlock isn't the worse thing ever, yeah its embarrassing. ( I made a cosy for mine LOL) I got the notice yesterday that I can come in and have mine taken out. The court order was for a year but because I did ASAP they suggested 6months and the judge signed off on it. There is light at the end of the tunnel. I promise

I got to the atty yesterday, thought I was going to barf in his office tho, my friend drove me and went with me cuz I was just a shaking mess. He is a former DA, and this is all he does. He says here in Colorado, you have zero rights with the DMV, and 99% of folks loose their license for a year, no work permits, nada.....I forgot to ask him if your DUI is a not guilty, or dismissed, how they can take your license for nothing...will have to ask that. He read over everything and said that the field handheld breath units, are not admissible in court, and that's all they gave me. He said they were supposed to take me to the big machine at the state patrol or the jail, and do that one to prove I was over the limit, they didn't. He said that will make a big difference. How much, I don't know. He is very very good at what he does, supposed to be the best, esp. since he's been on both sides, and decided that folks were loosing their rights by being railroaded. He said I have to go to the DMV tomorrow and ask for a hearing and he'll go, said it'll take til mid May, but they will most likely take my license, I just don't understand how they do that before you are convicted of anything, its like he said yesterday, you are innocent until THEY prove you are guilty. I was so tired, I probably didn't get it all.... He got a "pass" to let me leave Colorado, and the judge has to sign it and order it, but he said that's not a problem, should be done by Friday, and the mandatory calling in for the breath test, he's trying to get eliminated, cuz I can't call in from Texas, and then find a place in Texas, they don't do that there...so he thinks that'll be taken care of. I am going to do the alcohol awareness class and the MADD 2 hr thing when I get back here the week after the 9th. What does the alcohol awareness class entail?? I forgot to ask that too, but he said what Simey said, it looks good and you want to do it soon, and then you don't ever have to worry about probation, then I couldn't leave the state of Colorado. Anyway, he seemed really pissed by the way they handled things, and thinks it may end up not being as bad as we originally thought, also, the girl with me that they drove home, when the trooper got her home, her parents were there, they told me at the jail that they didn't drive her home, it was illegal, they just mess with you, anyway, they tricked her and asked her if she wanted to blow to see just what she would have tested had she been drinking, so she'd know better....she DID, she shouldn't have, and the atty. said they only did that so we can't use her as a witness, which indicates they knew they didn't follow things properly. I have had a pit in my stomach ever since I read about your situation yesterday. I was glad to get the update today. Your story has led me to believe each and everyone of us will get a DUI if we continue on the path w/alcohol.

I like to listen to Doctor Dean Edell on the radio. He is certainly no fan of drinking of driving by any means but also points out that cold medicine or allergy meds can make you dangerous behind the wheel, other prescription drugs do the same, lack of sleep, children in the car, sneezing disorients you for a period of time, etc. Alcohol has certainly been singled out as the villan though where you lose your license and have possible jail time, and certainly inconvenient consequences.

I don't want this to be misunderstood. Drinking and driving can be deadly and is a very serious matter. I am so glad you are ok and everyone else is too, as I know you are.

Nice to see some old timers with experience on the matter posting too! Provides a level of comfort I think that those of us who have just been lucky so far cannot.

Thanks Lucky, we are going to point out about my cancer and complete hip to hip surgery, and the fact that my remaining "innards" are wired up and or stapled, which makes a really deep breath too hard to I guess blow hard enough, I swear I could've blown up a balloon I was trying so hard...he said after telling them I had medical issues, they should've immediately taken me to the hospital for a blood test, and they don't have any levels on me.....

TIT, that's good. Get everything from your doctors, but DON' admit to any medications. They can prove nothing unless you give it to them. I believe drinking and driving is deadly, but as pointed out, many other things have the same effect. Did you know that they did test with legally drunk drivers and drivers on their cell phones, and the ones with the cell phones performed worse? Just saying.

I'm just hoping for the best, the main thing is, I have to have a way to get around, and Colorado seems not to care, I really like my atty., and he's good friends with my friends here, and the gal in the car with me, is his wife's best friends daughter, so he has our best interest at heart I know. In my state and most others if you fail a breathalizer or blood test and are driving then you have an automatic administrative suspension of your drivers license. I think this is called "implied consent" and is due to the fact that driving a car is a privelge, not a RIGHT. This is completely independent of the criminal actions of the courts and is between you and the DMV.

Well, I didn't fail it, I couldn't even do it, and they didn't do a blood test, but they took it anyway, have to go tomorrow and request a hearing, can drive till then, atty said it'd take til about the end of May, then he'll go try to fix it...but he said Colorado is tough, thing is, if the criminal deal is dropped, how do they justify keeping your license?? They don't have anything but what they wrote about my field test, which atty said is what they write on every single one....I'm just mortified....I deserve whatever I get for having the 2 and driving, but it seems like they have to let you make a living or live period...I don't care if they put the monitor in the car!!!

Just kidding, but all kidding aside I think you have a good case-- no real tangible evidence. I hope that it gets dismissed on these grounds and this keeps you sober on the road. The fact that I drove drunk with my family in the car haunts me forever, I never want to endanger anyone again. Best of luck,
