Hey Becca....prayers going up for y ou...I must say that I agree with everyone here...if it has 'really' come to this, you must try to secure your current residence if possible..it's best for the kid's too...
if this is a response to an incident..remember not to make any major decisions when you are in such a fragile stage of transition..and right before Xmas..unless of course, it's his decision, and you may want to ask him to wait until after the holidays to discuss it rationally..

of course...I have no idea of what the circumstances are...just thinking of the 2 times I left my first husband and recently when my husband and I almost separated....

Oh Beccs!!!!!......Is this something you have chosen, or is it a 'he' decision??? Everyone so far has pointed out the legal benefits of staying put, so I presume that the appartment is your own....Do you not have a citizens advice type thingy where you are that you could consult before the decision is made??
If you REALLY feel that you just need to get out, perhaps there is someway of doing this without compromising your position???
I can't help in any practical way, but my heart goes out to you (been there, done that, also with a child) it is a TERRIBLY unsettling time when this happens, and a rotten holiday period to boot....
