Employment background check?

A potential employer is doing one of these on me and I am wondering ... Can they actually get access to my medical history for this??? I don't have any drunk driving convictions or anything like that but there is stuff in my medical history. I am in the U.S. ... thanks

I believe that any health information records that can individually identify you is protected under the Health Insurance Portability and Accountability Act, with criminal penalties for privacy violations. You should be ok. They're probably only checking for criminal stuff.

I work in HR and run background checks every week. We do not have access to your health records. We do find DUI's through a driver check, and will find drugs through the drug screen we perform, but I wouldn't worry at all about your private health records.
